1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Lytespace Technologies Private Limited(CIN: U46909TZ2026PTC038984), a company incorporated under the Companies Act, 2013, with its registered office at 107, Gurusamy Nagar, Thaneer Pandal, Peelamedu, Coimbatore South, Coimbatore - 641004, Tamil Nadu, India ("Lytespace", "we", "us", or "our").
GalaHub ("the Platform") is a product of Lytespace Technologies Private Limited, accessible at galahub.in. By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
2. Eligibility
- You must be at least 18 years of age to register, access, or use the Platform.
- By using the Platform, you represent and warrant that you meet this age requirement and are legally competent to enter into a binding contract under the Indian Contract Act, 1872.
- Use of the Platform by persons below 18 years is strictly prohibited. If we discover that a user is under 18, we will immediately terminate their account.
3. Nature of the Platform
GalaHub is an online marketplace that connects customers seeking event services with independent vendors ("Vendors"), including venues, caterers, photographers, decorators, and related service providers, across India.
Lytespace is not a vendor, event organiser, or party to any agreement between a customer and a Vendor. We provide the technology infrastructure to facilitate discovery, communication, and bookings. The contractual relationship for the underlying service exists solely between the customer and the Vendor.
4. User Accounts
- You may register as a Customer (to search and book vendors) or a Vendor (to list your services and manage leads).
- You must provide accurate, complete, and current information at registration and keep it updated.
- You are responsible for all activity that occurs under your account and for maintaining the security of your login credentials.
- You must not share your account with any other person or allow others to use your account.
- We reserve the right to suspend or permanently terminate any account that violates these Terms, without prior notice.
5. Vendor Listings
- Vendors are responsible for ensuring that their listings, including service descriptions, pricing, photographs, availability, and packages, are accurate, complete, and not misleading.
- Vendors must not list services they are not authorised or equipped to provide.
- GalaHub does not independently verify all vendor credentials or representations. Customers are encouraged to exercise due diligence before booking.
- Vendors agree not to solicit or accept payments outside the Platform for bookings initiated through GalaHub.
- GalaHub reserves the right to remove or suspend any listing that violates these Terms or is found to be inaccurate.
6. How Bookings Work
GalaHub operates on a
token-based lead model:
- A Customer selects a Vendor and submits a booking enquiry by paying a booking token (a partial advance amount displayed at the time of booking).
- The Vendor receives the lead and has 48 hours from the time of submission to accept or decline.
- If the Vendor accepts, both parties are expected to log further progress on the Platform (e.g., confirming event details, agreeing on a quote, or scheduling a consultation). The token is credited toward the final service payment.
- If the Vendor declines, or if the lead expires without a response, a full refund of the token is processed (see Section 7).
- A booking is considered "active" when the Vendor has accepted and at least one meaningful interaction or update has been logged by either party on the Platform.
7. Payments, Cancellations, and Refunds
Payments- All amounts are in Indian Rupees (₹) and inclusive of applicable taxes unless stated otherwise.
- Payments are processed through authorised third-party payment gateways (currently Razorpay). GalaHub does not store your card details or payment credentials.
Refund Policy- Vendor no-response: If the Vendor does not accept or decline your booking within 48 hours, your token is automatically refunded in full. No action is required from you.
- Vendor decline: If the Vendor declines your booking, your token is refunded in full.
- No meaningful progress: If the Vendor accepts but neither the customer nor the Vendor logs any significant update or interaction on the Platform within 24–48 hours of acceptance (e.g., no messages exchanged, no quote agreed, no follow-up logged), you are eligible to request a full refund. - Active booking cancellation: If both parties have exchanged meaningful updates on the Platform and the booking is in progress, the token is non-refundable upon customer-initiated cancellation, as it represents confirmed vendor time and availability.
- Refund processing time: Approved refunds are processed within 5–7 business days to your original payment method, subject to bank timelines.
Platform ObligationBoth Customers and Vendors are required to update the Platform with any significant progress, decisions, or changes to the booking. Conducting bookings entirely off-platform after the initial lead is a violation of these Terms.
8. RSVP and Event Management Features
GalaHub provides RSVP management tools for event hosts. By using these features, you agree:
- Not to send unsolicited communications or spam guests.
- Not to misrepresent event details, hosts, or venues to RSVP respondents.
- That RSVP data collected belongs to the event host and is processed by GalaHub solely to facilitate the feature.
9. Prohibited Conduct
You agree not to:
- Use the Platform for any purpose that is unlawful under Indian law.
- Post false, misleading, defamatory, or fraudulent content, listings, or reviews.
- Attempt to gain unauthorised access to any part of the Platform, other user accounts, or our infrastructure.
- Interfere with or disrupt the operation of the Platform.
- Scrape, copy, reproduce, or redistribute Platform content without explicit written permission from Lytespace.
- Use the Platform to harass, threaten, or abuse other users or Vendors.
- Impersonate any person, business, or entity.
- Engage in any transaction designed to circumvent GalaHub's booking process or fees.
10. Reviews and User Content
- Users may submit reviews and ratings of Vendors after a completed booking.
- Reviews must be honest, based on genuine experience, and not defamatory or abusive.
- By submitting content on the Platform, you grant Lytespace a non-exclusive, royalty-free licence to use, display, and moderate that content.
- We reserve the right to remove any content that violates these Terms or applicable law.
11. Intellectual Property
All content on the Platform, including the GalaHub name, logo, design, software, and text, is the exclusive property of Lytespace Technologies Private Limited and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India.
Vendor-provided content (photographs, descriptions, etc.) remains the intellectual property of the respective Vendor. By uploading content to the Platform, Vendors grant Lytespace a non-exclusive licence to display and promote such content for the purpose of operating the Platform.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- Lytespace is not liable for the quality, safety, legality, or delivery of services provided by Vendors listed on the Platform.
- Lytespace is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to vendor non-performance, event cancellations, or loss of data.
- Our aggregate liability for any claim arising out of these Terms shall not exceed the amount of the booking token paid by you for the specific booking in dispute.
Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, to the extent such limitation is prohibited by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Lytespace Technologies Private Limited, its directors, employees, and affiliates from any claims, losses, liabilities, damages, and expenses (including legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) any content you post or submit; or (d) your violation of any third-party rights.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act 1872, the Information Technology Act 2000, the Consumer Protection Act 2019, and the Digital Personal Data Protection Act 2023.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu, India.
15. Dispute Resolution
In the event of any dispute, both parties agree to first attempt resolution through good-faith negotiation. If the dispute remains unresolved within 30 days, either party may refer it to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Coimbatore, Tamil Nadu, and proceedings shall be conducted in English.
16. Changes to These Terms
We reserve the right to update these Terms at any time. The revised Terms will be posted on this page with an updated effective date. For material changes, we will notify registered users via email. Your continued use of the Platform after any change constitutes your acceptance of the updated Terms.
